TERMS OF SERVICE

Our website address is: http://hifiselector.com

1. Acceptance of Terms

These Terms of Service (“Terms”) govern access to and use of this website and its related services (the “Platform”).

By accessing or using the Platform, you acknowledge these Terms. Where you create an account, claim a business profile, submit content, or purchase services, you may be required to expressly accept these Terms or additional applicable terms.

If you do not agree with these Terms, you should not use the Platform.

2. Independent Platform Status

The Platform is an independent informational directory, discovery platform, and industry aggregator focused on Hi-Fi, High-End Audio, Home Theater, Professional AV, Audio Streaming, media, events, dealers, manufacturers, and related industries.

Unless explicitly stated otherwise, the Platform is not affiliated with, endorsed by, sponsored by, authorized by, or acting on behalf of any manufacturer, brand, distributor, dealer, retailer, publication, reviewer, YouTube channel, event organizer, streaming service, or other entity appearing on the Platform.

3. Database and Platform Intellectual Property

Individual facts, company names, trademarks, third-party images, product information, and other third-party materials remain subject to the rights of their respective owners and are not claimed as the exclusive property of the Platform merely because they appear within the directory.

However, to the extent protected by applicable law, the Platform’s original:

  • selection and arrangement of information;
  • taxonomy and classification systems;
  • category relationships;
  • database organization and architecture;
  • editorial enrichment;
  • original descriptions and editorial materials;
  • compilations and curated collections;
  • website design and original interface elements

constitute intellectual property of the Platform or its licensors.

Nothing in these Terms transfers ownership of third-party intellectual property to the Platform.

4. Prohibited Activities and Anti-Scraping

Without prior written authorization, you may not systematically copy, extract, harvest, reproduce, republish, aggregate, commercially exploit, or reuse substantial portions of the Platform or its database.

Prohibited activities include:

  • automated web scraping or bulk data extraction;
  • systematic harvesting of listings, metadata, categories, classifications, descriptions, images, rankings, or database relationships;
  • mirroring or substantially reproducing the Platform’s directory or database structure;
  • using Platform data to create, populate, or materially enhance a competing directory, database, commercial service, or dataset;
  • circumventing technical measures intended to limit automated access;
  • repeatedly extracting smaller portions of the Platform where the cumulative effect is equivalent to extracting a substantial portion of the database.

The use of Platform content, database records, listings, metadata, classifications, taxonomies, rankings, descriptions, images, relationships, or other materials for Artificial Intelligence training, machine learning systems, large language models, automated knowledge extraction, synthetic datasets, dataset creation, model evaluation, retrieval databases, or similar computational purposes is prohibited without prior written authorization, except where such restriction is prohibited by applicable law.

This section does not prohibit ordinary indexing by legitimate general-purpose public search engines that comply with the Platform’s robots.txt, applicable technical instructions, and normal search-engine indexing practices, provided such indexing is not used for unauthorized database replication, dataset construction, or AI model training.

5. User-Generated Content

Registered users, brands, dealers, businesses, partners, or authorized representatives may be permitted to submit or manage content including logos, photographs, text, contact information, event information, business information, and other materials (“User Content”).

You retain ownership of User Content that you own.

By submitting User Content, you grant the Platform a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, resize, technically optimize, distribute, and promote that content to the extent reasonably necessary to operate, present, market, and promote the Platform and the relevant listing.

You represent and warrant that you possess all rights, licenses, permissions, and authorizations necessary to submit the content and grant this license.

6. Business Profiles and Authority to Act

If you create, claim, manage, or request control over a profile belonging to a brand, dealer, distributor, event organizer, publication, or other business, you represent and warrant that you are authorized to act on behalf of that entity.

The Platform may request reasonable evidence of authorization and may reject, suspend, or revoke access to a business profile where authorization cannot be established or where conflicting claims arise.

7. Indemnification

To the extent permitted by applicable law, users who submit content, operate business profiles, or otherwise provide materials to the Platform agree to indemnify, defend, and hold harmless the Platform, its operator, owners, affiliates, contractors, and service providers from claims, damages, liabilities, reasonable legal fees, and expenses arising from:

  • submitted content;
  • infringement of third-party rights;
  • unauthorized representation of a business or rights holder;
  • violation of these Terms;
  • unlawful use of the Platform.

8. Platform Rights

Subject to applicable law and any specific written agreement governing paid services, the Platform reserves the right to correct, update, modify, refuse, suspend, restrict, reorganize, or remove listings, profiles, images, text, events, accounts, links, or other content where reasonably considered necessary for legal, editorial, integrity, security, operational, technical, or business reasons.

The existence of a listing does not create a right to permanent inclusion, visibility, placement, ranking, or availability.

9. Free Listings and Commercial Services

The Platform may include businesses or other entities without charge and without any contractual relationship with them.

Inclusion of an entity does not by itself indicate that the entity has paid for, approved, verified, or requested the listing.

The Platform may introduce paid subscriptions, enhanced business profiles, sponsored placements, advertising, promotional visibility, or other commercial services.

Any specific paid service may be subject to additional commercial terms presented before purchase.

Payment for a service does not create any right to editorial endorsement unless expressly agreed in writing.

10. Accuracy and Availability

The Platform makes reasonable efforts to maintain useful and current information but does not warrant that all information is accurate, complete, current, available, or error-free.

Information may change without notice, including business information, websites, contact details, product information, event dates, venue information, dealer status, or third-party service availability.

11. External Services and Links

The Platform may link to or integrate websites and services operated by third parties.

The Platform does not control those services and is not responsible for their availability, security, content, policies, commercial practices, or subsequent changes.

12. Limitation of Liability

The Platform is provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by applicable law, the Platform and its operator disclaim warranties concerning the accuracy, completeness, reliability, availability, or fitness of Platform information for a particular purpose.

To the maximum extent permitted by applicable law, the Platform shall not be liable for indirect, incidental, special, or consequential losses arising from reliance on Platform information, including travel costs, accommodation costs, purchasing decisions, missed events, business losses, or lost opportunities.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. Suspension and Termination

The Platform may suspend or terminate access to accounts or functionality where reasonably necessary because of:

  • violations of these Terms;
  • security threats;
  • fraudulent activity;
  • repeated intellectual property infringement;
  • unauthorized business-profile claims;
  • unlawful activity;
  • abuse of Platform functionality.

14. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

15. No Waiver

Failure by the Platform to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

16. Entire Agreement

These Terms, together with any policies or additional terms expressly incorporated by reference, constitute the agreement governing use of the Platform, subject to any separate written commercial agreement applicable to specific services.

17. Changes to These Terms

These Terms may be updated periodically to reflect changes in law, Platform functionality, services, or business operations.

The current version and its effective date will be published on this page.
